As author and publisher of architectural books, I have long operated on the premise that anything visible from the public right-if-way is in the public domain, so that any photograph taken from the street, or from the air, is the property of the photographer with no rights reserved by the property owner. I suppose this would be the case with the architect, but have never come across this question. No doubt, like most law, interpretation would have to be determined by a court.

In very few instances over the years have I encountered anyone who was not pleased with exposure of property or work by publication. In those instances either the objector seemed to be paranoid or else was an opportunist who unrealistically supposed that the image of the property had signigicant financial value. Other publishers are the most likely to want compensation.
