There were many Germans who left much later than Ludwig Mies van der Rohe, so, no, I don't think it's implicit in his "staying until 1938" that he was in any way a Nazi. If anything, Mies had reason to hate the Nazis for nearly ruining his career. Another thing to consider is that people were not allowed to simply leave Germany at any time. One had to be careful and crafty to survive among the Nazis, especially when one had Jewish clients. I think he simply bided his time, waiting for the right opportunity to get out, as many others did.
