Hello,

I'm in contract to purchase a 3-property assemblage; combined 12,000 sq ft lot size with three separate, different size buildings on it.

Zoning for all three is r7-1/c1-3

I wonder if someone would help me understand some basics as to what is, by right, available to build.

My research shows that r7-1 allows a FAR of 3.44

And, that a C1-3 overlay on r7-1 allows a commercial FAR of 2.0

Does that mean the total building FAR is 5.44 or is it still 3.44?

Does the C1-3 overlay negate the setback requirements of the r7-1?

The property is on a main retail avenue, where all other (and the existing) buildings) are build to the street lot line.

How difficult is to use the air rights potentially purchased from the neighbors for use in the new construction?

Is it, zoning-wise, advantageous to keep facade of the biggest building there now, so as now to be restricted by the requirements of new construction (such as parking)?

I spent 10 years in NYC doing code consultation and zoning analysis, but I have since moved from the area. I can honestly say you have quite a complicated situation here. I still have the zoning resolution of NY and I will read into it tonight to try to answer your questions. I happen to know some great consultants in NY who was actually a former deputy commisioner of the building department who can help you. I believe he would give you a free consultation on your property and you can decide then if you will use them to file your building. It is a very complicated processs and you will need the assistance of someone who specializes in this type of thing as the NYC zoning resolution is probably one of the most complicated in the land. There are many things that you would never forsee without a consultant. Post your e-mail and I will send you there information for you to contact.
