Message - 3dsmax5 animated background - faking depth

I have an animated background - a street scene - in which my building model is set and changes form.
The building is in the middle ground of the frame (or has the illusion of being in that postion) which is not a problem until a person walks across the foreground...thus walking 'behind' my model.

is there any way I can solve this problem - creating a mask?? (don't know how this would be done) could I use combustion or after effects, or is it a case of tweaking the video before importing it as a background.

i can only think of deleting the required parts of the building frame by frame - but I don't think that's worth my time.

any thoughts much appreciated.
