[NLC] Invitation to join opposition to HBA LUBA appeal of MiCAP

Hello all,
As many of you know by now, the Home Builders Association has filed a
"Notice of Intent to Appeal" the MiCAP amendments adopted by City Council.
We know that the HBA will appeal at least the following three amendments:
5 -- SUNA height transition
7 -- University area parking requirements
8 -- River Road and Santa Clara natural storm water drainage protection
They may appeal other "neighborhood friendly" amendments, as well.
A group of neighborhood advocates are filing a "Motion to Intervene"
on behalf of the Respondent (i.e., the City, defending the decisions).
By filing as Intervenors, we assure the chance to file a written
brief opposing the HBA appeal. We may also want to file a
"counter-petition" appealing the three amendments the HBA wants to
see adopted. None of that has to be decided now. The "motion to
intervene" filing is just a placeholder.
There's no cost other than a few stamps (under $5.00), and no
downside that we're aware of.
I will create the "motion to intervene" forms. To join, all a person
has to do is sign the forms.
We're inviting individuals from other neighborhood associations to
join this motion. You would sign as an individual, not representing
your NA. However, having Intervenors from multiple NAs will let HBA
members know that they've generated opposition from (individual)
leaders from a broad spectrum of NAs.
So far, individuals from the following NAs have signed on:
-- River Road Community Organization
-- Santa Clara Community Organization
-- West University Neighbors
-- South University Neighborhood Association
-- Jefferson Westside Neighbors
-- Whiteaker Community Council
If you testified in writing and/or orally before the City Council on
the MiCAP amendments and would like to sign on, please send me an
e-mail with the following contact info:
-- Name as you would like it to appear
-- Address
-- Phone number
Also, please indicate "Yes" or "No" to the following two questions:
1. Did you testify in writing to the City Council?
2. Did you testify orally at the City Council public hearing?
Let me know if you have any questions.
This is an important opportunity for neighborhood advocates to show
solidarity in fighting to protect our neighborhoods against
thoughtless development.
