[NLC] Charter Amendments

Hello Neighborhood Leaders. At least three neighborhoods that I am
aware of are pursuing amendments to their charters. Questions have been
raised about the process for handling amendments. For clarification, I
would like to review the process for approval that was adopted by City
Council in January 28, 1981. The process reads as follow
Amendments to a previously approved charter by the City Council may be
adopted by the general membership of a neighborhood organization in
accordance to its charter, and submitted for approval to the
Neighborhood Liaison staff, with concurrence by the City Manager and
City Attorney. An amendment shall be submitted to the City Council for
approval it it is: 1) in conflict with the intent of the recognition
policy; 2) is not similar to amendments previously approved by the
council in other charters or 3) is substantially equivalennt to a new
charter.
Copies of amendments to a neighborhood charter will be sent to the
council to take effect in thirty (30) days unless a councilor requiests
that the amendment be brought to the council.
I have attached a copy of the Neighborhood Organization Recognition
Policy to help with #1 above. #2 will take some discussion with our
office but I think we can assume these would be relatively minor and not
substantively change the direction or operating procedure of the group.
#3 appears self explanatory and sounds like a rewrite of a charter.
In the future, please give our office a call to discuss your interest in
amending a charter. We will work with you to determine if the amendment
can be processed administratively or will require Council approval.
When pursing an amendment, please provide this office with the revised
charter (electronic format) and verification from the Executive Board of
the amendments being pursued, the process that was followed and includes
the date it was approved. Please keep in mind that amendments are not
in effect until approved administratively or by City Council. We will
do our best to move them through the appropriate process as quickly as
possible.
